
Terms & Conditions
Custom Japan Tours (“we,” “our,” “us”) provides bespoke travel experiences across Japan. By booking or using our services, you agree to the following Terms & Conditions. Please read them carefully before proceeding.
1. Booking & Payment

Booking Confirmation: A 50% deposit is required at the time of booking to confirm your reservation. The remaining 50% balance is due no later than 30 days before the start date of your itinerary. For bookings made within 30 days of the start date, full payment is required at the time of booking.

Payment Methods: Payments can be made via bank transfer, credit card, or other agreed-upon methods. All transactions are processed in Japanese Yen (JPY).

Currency & Taxes: All prices are quoted in JPY and include applicable consumption tax unless otherwise specified.
2. Cancellation & Refund Policy
We understand that travel plans can change, and we strive to be fair and transparent with our refund policy:

More than 48 hours before the itinerary start date: 95% refund of the total tour cost. A 5% administrative fee will be retained to cover time spent on itinerary planning and administrative expenses.

Less than 48 hours before the itinerary start date: No refund is provided due to the finalisation of bookings and preparations. We are happy to provide documentation to support any travel insurance claims.

Cancellation by Us: In rare cases where we must cancel a tour due to unforeseen circumstances or insufficient bookings, you will be offered an alternative or a full refund.
3. Itinerary Changes

Modifications by Us: We reserve the right to make necessary changes to the itinerary due to unforeseen events such as weather, transport delays, or operational issues.

Client Requests: Significant changes requested by you after booking may incur additional costs.

Unforeseen Changes: We will always strive to substitute cancelled experiences with suitable alternatives of similar value.
4. Client Responsibilities

Travel Documentation: You are responsible for ensuring you have valid passports, visas, and any required travel documentation.

Health & Special Requirements: Please notify us of any medical conditions, dietary restrictions, or special requirements at the time of booking. We will do our best to accommodate but cannot guarantee all requests.

Behaviour: We reserve the right to remove any guest from the tour without refund if their behaviour is deemed unsafe, disruptive, or disrespectful to staff, guides, or other guests.
5. Liability Disclaimer

Third-Party Providers: We act as an intermediary between you and third-party service providers (hotels, transport companies, attractions). We are not responsible for the acts or omissions of these providers.

Limitations of Liability: We are not liable for personal injury, illness, property damage, or other loss caused during the tour, except where required by law.

Force Majeure: We accept no responsibility for events beyond our control, including natural disasters, strikes, pandemics, accidents, or governmental restrictions that may affect your travel plans.
6. Insurance
We strongly recommend that all clients purchase comprehensive travel insurance that covers trip cancellation, medical expenses, personal liability, and luggage protection.
7. Privacy & Data Protection

Data Collection & Use: We collect only the personal data necessary to plan and operate your tour, such as names, contact details, and travel preferences.

Data Protection Compliance: We comply with the Act on the Protection of Personal Information (APPI) of Japan and observe applicable international standards, including the EU General Data Protection Regulation (GDPR), Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), and Australia’s Privacy Act.

Use of Information: Your personal data will never be sold or misused and is only shared with third parties when required to facilitate your travel arrangements.

Security: We take reasonable precautions to protect your data from unauthorised access.

8. Governing Law & Dispute Resolution

Jurisdiction: These Terms & Conditions are governed by the laws of Japan.

Dispute Resolution: Any disputes shall be resolved through the Tokyo District Court as the court of exclusive jurisdiction.
9. Amendments
We reserve the right to amend these Terms & Conditions at any time. Any updates will be posted on our website and will take immediate effect upon publication.
